Orlando Judge Will Not Release Champion Case Affidavit


May 2, 2012 | WMFE - An Orlando judge has denied a motion filed by two media outlets asking to release a probable cause affidavit used for the arrests of 13 defendants charged with the hazing death of a Florida A & M University drum major. Eleven of those defendants are facing felony charges, two are charged with misdemeanors.

The judge ruled Friday that neither the Associated Press organization nor the Orlando Sentinel newspaper have the authority to intervene in the case of Robert Champion's death. However, the judge did recommend that the media groups seek an order requiring a government agency to carry out its duty. The suggestion leaves the door open for another court challenge.

The State Attorney's Office in Orlando has refused to publicly release the probable cause affidavit, saying it's exempt from being released because it's part of a criminal probe.
