Courts Disagree on Obamacare, Leaving Floridians in Limbo


July 22, 2014 | WMFE, Orlando - Conflicting court decisions Tuesday leave Floridians insured under the Affordable Care Act in limbo. The decisions apply to states like Florida that use the federal insurance exchange.

A Washington appeals court ruled the government can't subsidize insurance in these states. 

But, a Virginia appeals court ruled the opposite. That court upheld the subsidies.

Ken Peach of the Health Council of East Central Florida says the conflicting rulings create uncertainty for Floridians insured under the Affordable Care Act.

"This will overlap the next enrollment period, which starts later this year. So individuals who are considering tax credits, they won't know whether they're going to have those tax credits or not to assist in the purchase of health insurance."

The rulings are the latest in a series of legal challenges to the Affordable Care Act, or Obamacare. Peach says the U.S. Supreme Court likely will take up the issue.

In the meantime Floridians will be left wondering whether their insurance premiums will jump if the high court rules against the subsidies.
